Welcome to Headshot.ai. These Terms of Service (“Terms”) outline the legal agreement between you and Headshot.ai regarding the use of our website and services. Please read them carefully. By accessing or using our Service, you acknowledge that you’ve read, understood, and agreed to comply with these Terms. If you don’t agree, you should not access or use our services.

1. Overview of the Headshot.ai Service

Headshot.ai is an online platform that enables users to upload their photos and generate professional-quality AI-enhanced headshots. Our service utilizes artificial intelligence to produce high-resolution portraits based on the input and preferences you provide. This tool is particularly useful for professional branding, social media profiles, corporate directories, and more.

Our services are delivered via the internet, and they are accessible through our website. The experience is optimized for ease of use, quick delivery, and high-quality output without needing photography equipment or studio time.

2. Eligibility

To use our Service, you must be at least 18 years old or the minimum age in your country where digital consent is required. By using our services, you represent and warrant that:

  • You meet the minimum age requirement;

  • You have full legal capacity and authority to enter into these Terms;

  • All registration information you submit is accurate and up-to-date.

We reserve the right to refuse service, terminate accounts, or restrict access if we believe a user does not meet these eligibility criteria.

3. Accounts and Registration

Creating an account allows you to personalize your experience and access your project history. When you register, you agree to:

  • Provide true, current, and complete information;

  • Keep your credentials secure and confidential;

  • Notify us immediately of any unauthorized use of your account.

You are solely responsible for all activity under your account, whether authorized by you or not. If you suspect a breach, please email support@headshot.ai immediately.

4. Payments, Subscriptions, and Refunds

Some features of Headshot.ai are available only through payment. When you purchase a package or subscription:

  • You agree to pay the listed prices, including applicable taxes.

  • All payments are processed securely through our third-party payment provider.

  • Subscription-based services may automatically renew unless canceled before the renewal date.

  • Promotional pricing, discounts, or limited-time offers are subject to specific terms at the time of the offer.

  • Headshot.ai reserves the right to change pricing, billing cycles, or subscription features at any time with prior notice.

Due to the custom and digital nature of our AI-generated content, we do not offer refunds once the processing has started or the final files have been delivered. Exceptions may be considered on a case-by-case basis if:

  • A request is made within 48 hours of purchase;

  • The user has not yet downloaded or accessed the final generated files.

5. Free Trials and Promotions

From time to time, Headshot.ai may offer free trials, beta access, or promotional discounts. Such offers are available at our sole discretion and may be revoked, altered, or discontinued at any time.

Free trials may convert into paid subscriptions if not canceled before the trial period ends. It is your responsibility to manage and cancel subscriptions before auto-renewal if you do not wish to continue.

6. Order Cancellation and Account Termination

We reserve the right to cancel any order for reasons including but not limited to:

  • Errors in pricing or service descriptions;

  • Suspected fraudulent or abusive behavior;

  • Violation of these Terms.

You may cancel your order if it has not yet been processed. You can also delete your account at any time, which will remove your data from our platform in accordance with our data retention policy.

7. License to Use the Service

We grant you a non-exclusive, revocable, limited license to access and use our platform for personal, non-commercial purposes. This license does not allow you to:

  • Resell or distribute the service outputs without permission;

  • Reproduce or modify the platform’s software;

  • Reverse engineer or decompile any part of our service.

Violating these terms may result in termination of your license and access to Headshot.ai.

8. Ownership and Proprietary Rights

All software, visual interfaces, AI models, graphics, and intellectual property used in our service are owned or licensed by Headshot.ai. Except for the rights granted in these Terms, we retain all ownership of our brand, designs, trademarks, and service logic.

Generated headshots belong to you, the user. You receive a non-restricted, royalty-free license to use them for personal or commercial purposes. With your explicit permission, we may use your generated headshots as part of our promotional material or portfolio showcase.

9. Third-Party Services

We may use third-party services such as image processors, storage providers, and analytics tools. While we ensure these providers are reputable, we are not liable for their actions. Their services are governed by their own terms and privacy policies, and you should review them separately.

10. User Content

When you upload content such as photos, you:

  • Retain full ownership of your original images;

  • Grant us a limited, non-exclusive right to use your content for the purpose of generating your final headshots and delivering your order.

We do not use your uploads to train our AI or for advertising without your explicit permission. You are responsible for ensuring you have rights to any images you upload.

We reserve the right to monitor, review, or remove content that violates these Terms or applicable law.

11. Affiliate and Promotional Use

Participation in Headshot.ai’s affiliate or promotional programs must comply with our specific affiliate guidelines. Affiliates may not:

  • Use PPC advertising with our brand keywords;

  • Misrepresent the service or make false claims;

  • Spam users or mislead visitors about benefits.

We reserve the right to suspend or terminate affiliate privileges at our discretion.

12. Communication Preferences

By signing up, you agree to receive communications related to your account, such as password resets, order confirmations, and support updates. You can opt in to receive promotional messages, newsletters, or special offers-and unsubscribe at any time via email footer links or your dashboard.

13. Prohibited Conduct

By using Headshot.ai, you agree not to:

  • Violate any applicable laws or regulations;

  • Upload images that are offensive, abusive, discriminatory, explicit, or infringing;

  • Use the platform for illegal or harmful purposes;

  • Attempt to hack, disrupt, or overload our systems;

  • Impersonate others or provide false information;

  • Exploit the Service for commercial use without proper licensing.

We reserve the right to terminate accounts involved in prohibited conduct without prior notice.

14. Intellectual Property Rights Protection

We take copyright and trademark laws seriously. If you believe your intellectual property has been used on our platform without authorization, contact us at legal@headshot.ai with proof of ownership and a clear description of the issue.

15. Termination and Service Modifications

We may suspend or terminate your account at our discretion, especially in cases of policy violations or suspected abuse. We may also modify our service, remove features, or introduce new ones without prior notice.

Users may terminate their accounts at any time through their dashboard or by contacting support. Once deleted, user data and content will be removed in accordance with our retention policies.

16. Disclaimers and No Warranties

Our service is provided “as-is” without warranties of any kind, either express or implied. While we strive to offer a high-quality experience, we cannot guarantee uninterrupted access, flawless outputs, or compatibility with all systems.

We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the extent permitted by law, Headshot.ai and its affiliates are not liable for:

  • Indirect, incidental, or consequential damages;

  • Loss of income, reputation, or data;

  • Claims arising from your use or inability to use the service;

In no event shall our liability exceed the amount paid by you for the service in the prior six months.

18. Dispute Resolution and Arbitration

We encourage you to contact us directly to resolve any concerns. If we cannot resolve the issue informally, both parties agree to resolve disputes through confidential binding arbitration instead of court proceedings.

This agreement to arbitrate does not prevent either party from seeking injunctive relief in appropriate jurisdictions. You waive your right to participate in class action lawsuits.

19. Miscellaneous

These Terms constitute the full agreement between you and Headshot.ai. They supersede any prior communications, written or oral. If any section is found unenforceable, the remainder will remain in effect.

You may not assign these Terms to another party without our written consent. We may transfer our rights and obligations without restriction.
